Case: Nordyke v. King, 99 - 17551.
The Ninth Circuit certified a question of state law on the issue of preemption to the California Supreme Court. That issue was argued and decided in April of 2002. The citation is Nordyke v. King, 27 Cal. 4th 875. The California Supreme Court's is ruling did not resolve the case so it was transferred back to the Ninth Circuit.
The issues currently before the Ninth Circuit are the First Amendment and Second Amendment rights of gun show promoters, vendors and patriots to conduct gun shows with actual guns instead of pictures at county fairgrounds.
The case is awaiting a decision by the entire Ninth Circuit on a petition for en banc review. Nordyke is only case in the Ninth Circuit in which the three-judge panel agreed that the Second Amendment protects an individuals "right to keep and bear arms." However that panel did not have the power to overturn circuit precedent and instead invited the Nordykes to file for en banc review.
